Information Confidentiality

The terms “Confidential Information” and “Restricted Use Information” mean that all information disclosed, provided, communicated or obtained, be it verbally or in writing, in electronic form or not, related to the know-how, techniques, designs, specifications, copies, diagrams, images, logos, forms, models, samples, flowcharts, computer programs, disks, tapes, texts, drawings, pictures, graphs, projects, methodologies, business vision, operation format, services to be provided, information on planned or delivered solutions to customers, and other techniques, financial or commercial, as well as the form of presentation of the solutions and communication approach including all the documents related to the Business, as well as any other disclosed information, by its representatives or people hired for the execution of the Business.
Obs.: The “Restricted Use Information” refers to information which will only be allowed to be used inside the facilities of EmcTest.

Thus, for any information accessed through Emctest's Intranet, Internet or Extranet, its users must follow the privacy policy bellow:
- They are obliged to keep all “Confidential Information” or “Restricted Use Information” in secret and take all possible actions to minimize the risk of disclosure, making sure that only the authorized representatives have access to its content, within the necessary limits.
- Assure that the “Confidential Information” or “Restricted Use Information”, in the forms described in the initial concept, are not copied or reproduced in any way, without the previous and expressed permission from the proprietary of such information.
- Guarantee the safety and control of all the “Confidential Information” or “Restricted Use Information” in written or in another physical form which is able to identify this information, restricting the location and the use of the restricted access areas and keeping this information in safe and locked places, while not in use.

Responsibilities

It is strictly prohibited to perform any action or conduct that violates the laws, regulations or norms determined by the community of the Internet, Extranet or Intranet, or that could damage the facilities, the network, the reputation, the good faith, or the relationships with Emctest's customers, expressly mentioned or not in this Policy of Use.

The user acknowledges that when obtaining access to the information through Emctest's Intranet, Internet or Extranet, he expressly agrees with the terms presented here. When identifying the non-compliance to these terms and other legal terms, Emctest is eligible, at its own criteria, to suspend temporarily or definitively the access to the site, without prejudice to other measures for determining the purpose of the improper practice, seeking to repair its consequences.

The user also understands that Emctest can modify this Policy of Use and Privacy, at any time, as well as the features available at Emctest's Intranet, Internet or Extranet, without previous notification to the user, who is recommended to consult periodically for updates.

Network and Systems Security

Violations to the security of Emctest's network and systems are prohibited, and may result in criminal or civil actions against the infringing party.

Emctest's Intranet, Internet or Extranet users cannot:
- Disclose Login and Password information to non-authorized people or strangers to Emctest.
- Obtain non-authorized access to or make use of data, systems or networks, or any attempt to investigate, examine or test the vulnerability of the network, of the network devices, or to violate the security of authentication measures, without expressed authorization.
- Perform or try non-authorized invasions to any equipment, file or systems of Emctest in order to invade, without authorization, any other network.
- Take advantage of non-authorized monitoring of data or traffic in any network or system, without formal authorization.
- Defraud security to obtain access to Emctest's services.

Emctest uses cryptography techniques, firewalls and other technologies and procedures applicable to security, aiming to protect the consistency and security of its information and prevent the non-authorized access or improper use.

It is prohibited to use Emctest's Intranet, Internet or Extranet, servers and services, including the design of these sites, to create, transmit, distribute, insert, store or make available any material that is illegal or that is a violation of this policy, abusive or harmful to the image of Emctest and its customers.

The links available at Emctest's Intranet, Internet or Extranet, to other Emctest-owned websites and access to software and systems developed or acquired by Emctest, are also included in the scope of this policy. Websites of Customers, Partners and Vendors, if mentioned at Emctest's Intranet, Internet or Extranet, its users must respect the Policies determined by these proprietors regarding the use and security. In this latter case, Emctest acknowledges its trademarks and patents, as well as its policies.

Software and systems of third parties can only be used with the respective license and when contracted and acknowledged by Emctest, even when accessed through Emctest's Intranet, Internet or Extranet.

Documents, Norms, Procedures, Policies, Operational Scripts, Programs, News, Marketing Materials, Description of Products and Services, list of Customers and their respective businesses, Knowledge Base, Articles, Managerial, Financial and Costs Information, as well as all the information published at Emctest's Intranet are Restricted Use information, therefore they cannot be used out of the company, without previous consent, nor disclosed, copied, altered to external sources.

Welcome to Emctest's website. Emctest respects and keeps your information private, and guarantees the necessary security to protect and sustain the integrity of the information available in its Intranet, Internet or Extranet.

Right of Use and Intellectual Property

The entire content of Emctest's Intranet, Internet or Extranet pages, such as information, specifications, diagrams, images, logos, forms, models, samples, flowcharts, computer programs, texts, drawings, pictures, graphs, projects, methodologies, business vision, operation format, services to be provided, information on planned or accomplished solutions to customers, and other techniques, financial or commercial, as well as the form of presentation of the solutions and communication approach including all the documents related to the Business, as well as any other information disclosed, by its representatives or people hired for the execution of the Business, belong to Emctest Tecnologia da Informação or to third parties that have legally provided rights of use. Emctest acknowledges the copyrights of its authors.
